Amazon Trademark Dispute Delhi High Court penalty on Amazon for 340 cr

On July 1, 2025, the Delhi High Court temporarily stayed its earlier ruling that ordered Amazon to pay ₹340 crore to Lifestyle Equities, the owner of the Beverly Hills Polo Club (BHPC) brand. The payment stemmed from allegations of trademark misuse involving products sold by Cloudtail India through Amazon’s platform. This stay order comes while Amazon appeals the original decision.

Amazon Trademark Dispute: How the Amazon-BHPC Dispute Began

The Beverly Hills Polo Club vs. Amazon case is an intellectual property rights (IPR) dispute that developed over several years. It all started when the Beverly Hills Polo Club (BHPC) trademark, which was registered in India in 2007, was allegedly misused by Cloudtail India, a seller on Amazon. Between 2015 and 2020, Cloudtail was said to be selling clothes with a logo that looked very similar to the BHPC logo. Since these products were sold on Amazon, and Amazon had a close business link with Cloudtail, both were held responsible.

On October 12, 2020, the Delhi High Court stepped in and issued a temporary order stopping the sale of the copied products. After more legal review, this order became permanent on March 2, 2023. Then, on February 26, 2025, the court made a big decision—ordering Amazon to pay ₹340 crore in damages and legal costs for trademark infringement. Amazon opposed the judgment in May 2025. As a result, on July 1, 2025, the court put the payment order on hold while the appeal is being considered.

Delhi HC’s Key Remarks on Amazon’s Trademark Appeal

Stay on the ₹340 Crore Order

This means Amazon doesn’t need to make the payment immediately, as the case is still under appeal.

No Need for Pre-Deposit

In an important decision, the court said Amazon doesn’t have to pay any part of the ₹340 crore right now, which is usually required in such cases. Instead, Amazon just needs to give a written promise to pay if it loses the case later.

Stay Doesn’t Affect the Appeal’s Merits

The judges clearly said that the stay doesn’t mean they’ve decided who is right or wrong. It’s just a temporary step to delay the payment until the final decision is made

Reason for Granting Relief

The court said it would be unfair to make Amazon pay such a big amount right now, especially since the appeal is still going on and the case involves complicated legal questions.

Next Steps in the Amazon vs. BHPC Legal Battle:

  • With the Delhi High Court stay on the previous order, now this case is under appeal.
