Fee reductions: Patents: all fees reduced by 90% if all applicants are also inventors, and by 80% if all applicants are non-profit institutions/organizations (80% for mixed applicants that are all either inventors or non-profit institutions/organizations). Utility models: all fees reduced by 80% if all applicants are also inventors, and by 60% if all applicants are non-profit institutions/organizations (60% for such mixed applicants).
National phase entry requirements
Time limit
Chapter I (PCT Article 22) and Chapter II (PCT Article 39(1)(b)): 31 months from the priority date
Translation
Under PCT Article 22: description, claims (if amended, as amended only, with any PCT Article 19 statement), any text matter of drawings, and abstract. Under PCT Article 39(1): description, claims, any text matter of drawings, and abstract (if amended, only as amended by the annexes to the IPER). Must be furnished within the 31-month time limit; a further two months is allowed if a written extension request and its fee are filed within the original time limit.
Late entry and reinstatement
Reinstatement of rights is permitted (PCT Rule 49.6): request in writing stating the grounds and facts, and pay the reinstatement fee of 200 UAH or equivalent in EUR or USD (reduced by 80% if all applicants are inventors and by 60% if all applicants are non-profit institutions/organizations; 60% for mixed applicants). Restoration of the right of priority is accepted under the unintentional criterion (PCT Rules 49ter.1 and 49ter.2); restoration fee 200 UAH or equivalent. Excuse of delays under PCT Articles 24(2) and 48(2) is available on request.
Agent and power of attorney
Required if the applicant is not resident in Ukraine. Any person registered to practise before the Office as a patent attorney may act. Appointment requires a power of attorney (model in Annex UA.III).
Special requirements of the office
- Instrument of assignment of the priority application where the applicants are not identical (may be satisfied by a declaration under PCT Rule 4.17)
- Appointment of an agent if the applicant is not resident in Ukraine
Other information
- If Rule 51bis requirements are not complied with within the PCT Article 22 or 39(1) time limit, the Office will invite compliance within two months of receipt of the invitation.
- Applicants may request processing as a utility model by indicating this when performing the Article 22 or 39 acts (PCT Rule 49bis.1). Conversion between patent and utility model applications is possible at any time before the decision to grant.
- The Office examines patent applications as to substance.
- Fee for amendment or correction of the application: 1,600 UAH or equivalent (additional 160 UAH per claim added and 6,000 UAH per independent claim added in patent applications).
- Renewal fees are payable from the first year after the international filing date; patents from 600 UAH (years 1-2) up to 30,400 UAH per year (years 21-25); utility models from 900 UAH (years 1-2) up to 6,300 UAH per year (years 9-10).
- Fees may be paid in UAH, EUR or USD, except the grant fee (100 USD), which must be paid in USD.
- Forms: Annex UA.II (national processing request), Annex UA.III (power of attorney), Annex UA.IV (instrument of assignment).
