International filing strategy

Direct filings or PCT: we choose per invention.

Most international patent families use both. We recommend the route based on your markets, budget, timing and how the patent will be used.

Office by office
Route 01

Direct (convention) filings

A separate application in each country, filed within 12 months of the first filing to keep its priority date.

Coverage
One country or region per application, such as the US, Europe or India.
Strengths
Faster examination in a few key markets, with specifications tailored to local practice.
Best for
A small number of countries that are already decided.
Watch out for
All translation and filing costs fall due at month 12.
One application
Route 02

PCT application

One international application covering 150+ member countries, followed by national phase entry where you need protection.

Coverage
All PCT member countries from one filing, chosen later at the national phase.
Strengths
Up to 30 or 31 months from priority to decide on countries and spread the costs.
Best for
Inventions with global potential and markets that are not yet decided.
Watch out for
National phase deadlines differ by country and cannot be missed.

FAQs

Questions about patent protection.

What inventors and companies usually ask before working with us.

Have an invention to protect?

Tell us what it does and where you want protection. We will propose a search, drafting and filing plan with fees.

Request a proposal
01What can be patented?

An invention that is new, involves an inventive step and can be made or used in industry. Some subject matter, such as abstract ideas or software as such, is excluded in many countries; we tell you early whether your invention qualifies.

02Should we search before filing?

Usually, yes. A patentability search shows what already exists, so you can decide whether to file and draft claims that avoid the prior art, saving cost and objections later.

03What is the difference between a provisional and a complete specification?

A provisional specification secures an early filing date while the invention is still being developed. The complete (non-provisional) specification, with claims, must follow within 12 months.

04Should we file a PCT application or file directly in each country?

It depends on how many countries you need and how soon. PCT gives more time and one filing for 150+ countries; direct filings suit a few known markets. Many families combine both.

05How long does it take to get a patent?

Typically two to five years from filing, depending on the country, the field and how examination goes. Expedited examination is available in some offices, including India.
